America250 Awards Contest

CONTEST OVERVIEW: America250 is looking for eligible persons (each, a “Submitter”) to nominate a “hero” in their life. Their “hero” should be someone the Submitter knows personally and whose actions are inspired by the historic events that took place on September 11, 2001 (“Nominee”). A Submitter may nominate themselves as a Nominee.
After being sorted by category (as described below), the Nominees addressed in the Entries (as defined below) will be reviewed and scored by a panel of judges comprised of representatives of the Administrator (as defined below) to determine up to thirty (30)* individual finalists (each a “Finalist” and collectively, “Finalists”). The Finalists as addressed in the Entries will then be reviewed and scored by a separate judging panel comprised of representatives of the Sponsor and Prize Partner to determine the potential individual winning Nominees (each a “Winner” and collectively, “Winners”). There will be three (3) Grand Prize (as defined below) Winners in total (one per Category). Submitters will not receive any prize or other benefit (except, perhaps, recognition in the sole discretion of the Sponsor) for participation unless he/she is a Winner (i.e., self-nomination).
By participating in the America250 Awards Contest (“Contest”), both the Submitter (“you”) and Nominee agree to be bound by and abide by these Official Rules (“Official Rules”) and the decisions of the Sponsor and the Administrator, which are final and binding in all respects and not subject to appeal.
*In one or more rounds of judging, the Sponsor/Administrator reserves the right to select fewer than the indicated number of Finalists or Winners (as applicable), if in the sole discretion of the corresponding judging panel, there is not a sufficient number of eligible Entries of sufficient quality.

Administrator: Probability LLC, 2 Woodstock Meadows Ln, PO Box 1484, Woodstock, NY 12498 (“Administrator”).
Eligibility: Submitters & Nominees must be legal residents of one (1) of the fifty (50) United States, the District of Columbia, or one (1) of the U.S. Territories and at least eighteen (18) years of age or the age of majority in their jurisdiction of primary residence (whichever is higher) at time of Entry. Any Submitters or Nominees who have, within the past six (6) months, performed services for (including but not limited to as employees, consultants, independent contractors, and interns) the Sponsor, the Administrator, the Prize Partner, NFL Entities (as defined below), any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prizes, and the entities owned and operated by those persons (collectively, the “Contest Entities”), and immediate family and household members of such individuals, are not eligible for nomination or to win any prize. (For clarity, donors and volunteers to the Sponsor ARE eligible to serve as either Submitters or Nominees.) "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Potential winners (i.e., Nominees) may be required to provide proof of legal residency upon request prior to prize award. Void where prohibited.
If selected as a potential winner, a Nominee may be required to consent to a background check to verify the preceding; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification without compensation of any kind. In addition, the Sponsor reserves the right in its sole discretion, to disqualify a potential Finalist (without explanation or compensation of any kind) if the results of such background check reveal that such potential winner does not meet the Contest eligibility requirements or has been charged with a felony, a crime of moral turpitude or an act of insurrection, or any other act which might reflect negatively on Sponsor or any of the Contest Entities, as determined by the Sponsor in its sole discretion. All such decisions of the Sponsor are final and binding in all respects and not subject to appeal.
Contest Entry: The Contest begins at 3:00 p.m. Eastern Time (“ET”) on August 5, 2021 and ends at 11:59 p.m. ET on October 10, 2021 (“Contest Period”). The Administrator’s computer is the official clock for the Contest.
During the Contest Period, Submitters may visit america250awards.org and click on the Contest image to access the Contest registration page (“Website”).
Step 1 (Registration): At the Website, Submitters must provide their full name, e-mail address, daytime phone number (with area code), full mailing address, and relationship to Nominee. Additionally, Submitters must also provide Nominee’s full name and email address, daytime phone number (with area code) and full mailing address. By submitting this information, Submitters represent and warrant that they have obtained the Nominee’s permission to submit an Entry that includes the Nominee’s personal information prior to submitting the Entry.
Step 2 (Submission of Essay): Once the Submitter has completed Registration, as described above, the Submitter must follow the on-screen instructions to submit an essay of no more than two hundred fifty (250) words describing why they are nominating the Nominee and how the Nominee is a heroic individual whose actions are inspired by the historic events that took place on September 11, 2001. (“Essay”). Submitter must also select which type of hero category (“Category”) their Nominee falls under: (a) Community Champion, (b) First Responder , or (c) 9/11 Hero. The Sponsor/Administrator reserves the right to re-assign an Essay to a different Category should the Essay not be suitable for the Category selected. If you are not nominating yourself, Nominee must be someone who is alive and who you know personally (e.g., a friend, family member, neighbor or co-worker). To submit an Essay, the Submitter must type their Essay completely in the text box portion of the Registration form. Essay must be submitted on-line as part of the Registration form (e-mail attachments or other forms of submission of Essay will not be accepted). Essays must comply with the Essay Guidelines in Section 5 below.
An entry (“Entry”) consists of an individual’s registration information AND Essay as described above. Steps 1 and 2 must all be completed in the same Internet session. Partial submissions will NOT be accepted.
IF THE SUBMITTER DOES NOT CHECK THE BOXES INDICATING THEIR AGREEMENT TO THE OFFICIAL RULES, CONFIRMATION OF ELIGIBILITY, AND ACKNOWLEDGING PERMISSION TO SUBMIT NOMINEE’S INFORMATION, THE SUBMITTER WILL NOT BE ABLE TO SUBMIT AN ENTRY INTO THE CONTEST FOR THEIR NOMINEE.
Limit one (1) Entry (registration and Essay) per Category per Submitter and/or e-mail address for a total of three (3) Entries per Submitter/e-mail address. Each Essay must be unique and nominate a different Nominee. Entries in excess of these limitations will result in the disqualification of all of your entries (and all persons nominated in such entries unless such persons are nominated in another Submitter’s eligible entry). Different Submitters may nominate the same Nominee; but a Nominee can win a maximum of one (1) prize. The number of entries nominating a Nominee will have no effect on the outcome of the Contest; however, the applicable judges will consider all entries nominating a given Nominee as part of the judging procedure. No group/club/business/organization may be a Submitter or Nominee. No joint entries; a single individual must be identified as the Nominee and a single individual must be identified as the Submitter submitting an Entry. The Sponsor and the Administrator will not be responsible for late, lost, incomplete, incomprehensible, damaged, or misdirected entries; all of which are void. All Entries become the property of the Sponsor and will not be acknowledged or returned. By participating in this Contest, Submitter and Nominee each agree to these Official Rules and the decisions of the Sponsor and the Administrator, which are binding and final in all matters relating to this Contest.
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond the Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process (whether a Submitter or Nominee), and to terminate, modify or suspend the Contest. In such event, the Sponsor reserves the right to conduct the Contest and award the prizes described herein comprised of all eligible Entries received prior to and/or after (as appropriate) the action taken by the Sponsor or otherwise award the prizes in a manner which is fair, appropriate and consistent with these Official Rules, or to terminate the Contest and not award the prizes, as determined by the Sponsor in its sole discretion. Notice of termination/modification/suspension of Contest will be posted on the Website. Without limitation of any other term herein, the Sponsor and its agents are not responsible for failed, partial, computer transmissions, technical failures of any kind (including but not limited to electronic malfunction or damage of any network, hardware or software), any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, Entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic, Entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Submitter’s or any other person’s computer related to or resulting from participation in this Contest.
Submitters further agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, THE SPONSOR MAY DISQUALIFY ANY SUBMITTER MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. (AND, IF SUBMITTER IS DISQUALIFIED, THE NOMINEE WILL ALSO BE DISQUALIFIED UNLESS HE/SHE IS NOMINATED BY ANOTHER SUBMITTER IN AN ELIGIBLE ENTRY.)
ESSAY GUIDELINES: Essays must be no more than 250 words. Based on the Sponsor's/Administrator’s sole judgment and discretion, Essays cannot (a) include or depict anyone younger than eighteen (18) years of age; (b) be sexually explicit or suggestive; threatening; profane; violent; derogatory of any ethnic, racial, gender, religious, professional or age group or sexual orientation; pornographic, contain any materially dangerous activity; (c) promote alcohol, illegal/prescription drugs, tobacco, (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, (d) be obscene, offensive, or endorse any form of hate or hate group; (e) contain trademarks owned by others, or advertise or promote any brand or product of any kind, or contain any personal identification (other than as related to the Nominee and which is essential to describing their actions), such as license plate numbers, personal names, email addresses or street addresses; (f) contain copyrighted materials owned by others without permission; (g) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission (the preceding includes but is not limited to the Nominee); (h) contain advertising or commercial messages of any kind; (i) criticize Contest Entities or any other Submitter or Nominee; (j) contain any recruiting information of any kind;, and cannot itself be in, violation of any law. Essay may not promote any cause, be it religious, political, corporate, charitable or otherwise, other than the Nominee him/herself. Do not include any confidential, private or proprietary information in the Essay as the Sponsor, the Administrator and the NFL Entities do not have any duty of confidentiality or other fiduciary duty as to the contents of any Essay.
By submitting an Essay you warrant and represent that: (a) it is your original work, (b) it has not been previously published, (c) it has not received previous awards, (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) you have obtained permission from each and every person who is mentioned in the Submission to include such information in the Essay (including but not limited to the Nominee); (f) it meets the Essay Guidelines; and (g) publication of the Essay via various media including the Sponsor’s and its affiliated entities’ website(s) and social media channels will not infringe on the rights of any third parties. Submitter further represents and warrants that he/she has first-hand knowledge of the actions and conduct of the Nominee as set forth in the Essay and, to the extent that he/she does not have such first-hand knowledge, the Submitter has a reasonable basis for believing that such actions/conduct of Nominee are truthful and accurate as described in the Essay. Submitter agrees to defend, indemnify and hold harmless, Contest Entities from any claims to the contrary. Any Submitter whose Essay identifies or references third parties or contains elements not owned by the Submitter (such as, but not limited to, references to persons or trademarks) must be able to provide legal releases for such use including the Sponsor’s use of such Essay, in a form satisfactory to the Sponsor, upon request, prior to naming of Submitter’s Nominee as a Winner. Any Essay that, in the sole opinion of the Sponsor, is deemed to be inappropriate for publication is ineligible.
By entering, Submitter and Nominee agree to indemnify and hold harmless Released Parties (as defined below) from any action or liability resulting from the publishing of his/her Essay and/or use of the Essay.
Should the Sponsor post an Essay, such posting shall not constitute any representation of eligibility of the Entry or notification that the Nominee has been selected as a prize winner.
ESSAYS REPRESENT SOLELY THE VIEWS/OPINIONS OF SUBMITTERS AND NOMINEES AND DO NOT REFLECT THE OPINIONS OF THE SPONSOR OR NFL ENTITIES, BOTH OF WHICH DISCLAIM ANY LIABILITY UNDER ANY LEGAL THEORY IN CONJUNCTION WITH THE POSTING OF SUCH ESSAYS. THE SPONSOR AND THE NFL ENTITIES WILL NOT EDIT OR MODIFY THE POSTING OF ESSAYS IN CONJUNCTION WITH THE CONTEST.
JUDGING (Winner Determination/Notification): Entries will first be sorted by category. Entries will then be initially judged on a rolling basis by a panel of judges comprised of representatives of the Administrator (“Administrator Judges”). For this first stage of judging, the Administrator Judges will review each of the Essays and select up to thirty (30) Finalists (i.e., ten (10) Finalists per category). The scoring by the Administrator Judges will be based on the weighted criteria below, each judged on a scale of 1-10 (10 being the highest) as follows:
- (50%) Action. How are the nominee’s actions inspired by or in honor of the heroism shown on September 11, 2001? Do they exemplify the intangible qualities of the American spirit through their extraordinary acts? Do the individual actions of the nominee exhibit selflessness and integrity?;
- (25%) Courageous Spirit. When the nominee took heroic action, did they go above and beyond what was required of them?; and
- (25%) Inspiration. Does the nominee’s heroic story inspire others to take action to serve their community and/or catalyze a more perfect union?
When the total scores are tabulated by the Administrator Judges, the top Finalists will advance to the next phase of judging. The Administrator Judges reserve the right to advance fewer than thirty (30) Finalists in total (and/or fewer than ten (10) Finalists per category) to the next round if, in their sole discretion, they do not receive a sufficient number of Entries/Nominees of sufficient quality in one (1) or more categories. The Finalists will then be judged by another judging panel from the Sponsor and Prize Partner (“Sponsor Judges”), which will select the Winners based on the judging criteria listed above. For the avoidance of doubt, the ranking of Finalists by the Administrator Judges will not be taken into account by the Sponsor Judges. The Finalist with the highest final score from the Sponsor Judges in each of the three (3) categories will be deemed a potential Winner. In the event of a tie in the second round of judging in a given category, the tie will be broken in favor of the Finalist with the higher “How are the nominee’s actions inspired by or in honor of the heroism shown on September 11, 2001? Do they exemplify the intangible qualities of the American spirit through their extraordinary acts? Do the individual actions of the nominee exhibit selflessness and integrity?” Action criterion among the tied Finalists; such Finalist will be deemed the Winner for that category. In the event a tie still remains, Sponsor will appoint a new judge, who will adjudicate the tied submissions in accordance with the above-stated criteria in order to break the tie. Should the same Nominee have the highest final score from the Sponsor Judges in more than one (1) category, such Nominee will only receive one (1) Grand Prize with the prize-winning category being determined by the Sponsor Judges in their sole discretion; and, in such case, the runner-up Nominee(s) with the second highest final score from the Sponsor Judges in the non-prize winning category/categories will win the Grand Prize in such non-prize winning category/categories. Prizes (as defined below) will be awarded to the Winners. The Submitters will not receive a prize or any other benefit (except, perhaps, recognition in the sole discretion of the Sponsor) of any kind, unless a Submitter is the Winner (i.e., self-nomination).
Each Submitter whose corresponding Entry/Nominee is selected as a potential Winner will be contacted by email and/or telephone on or about November 1, 2021. At time of contact, the Submitter will supply to the Administrator the corresponding Nominee’s contact information. By providing the Administrator with this contact information, Submitter represents and warrants that they have obtained the Nominee’s permission to supply such contact information. Submitter and potential Winner (assuming Nominee is a third party and not the Submitter him/herself) will be required to sign and return, within three (3) business days of notification, an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release, W-9 tax form, where allowed by law, along with the necessary paperwork for a background check and any release(s) required of Submitter/Nominee (collectively, (“Contest Documents”). Affidavit will also include a Grant of Rights from Submitters/potential Winners to the Sponsor, as detailed above. If a potential winner cannot be reached (regardless of reason), the Affidavit of Eligibility, Release and Indemnification, and Publicity Release, or any other portions of the Contest Documents are not returned to the Sponsor within the specified time period, or any prize notification is returned as undeliverable, the potential Winner may be disqualified. If a potential Winner is disqualified for any reason, the prize will be forfeited and an alternate Winner will be selected, i.e., the Finalist with the next highest score from the Sponsor Judges judging round for the applicable category (time permitting).
In the event of any dispute concerning the identity of any Submitter, the Essay will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Prizes and Approximate Retail Values ("ARV"):
Three (3) Grand Prize Winners (one (1) Winner per Category) will each receive a trip for two (2) to one of the following NFL football games scheduled to take place on November 25, 2021 (Thanksgiving Day): (a) Chicago Bears at Detroit Lions scheduled to take place at Ford Field in Detroit, MI at 12:30 p.m. ET, (b) Las Vegas Raiders at Dallas Cowboys scheduled to take place at AT&T Stadium in Arlington, TX at 4:30 p.m. ET, or (c) Buffalo Bills at New Orleans Saints scheduled to take place at the Mercedes-Benz Superdome in New Orleans, LA at 8:20 p.m. ET (the “Grand Prize Game”). The Grand Prize Game to be attended is at the Sponsor’s sole discretion, with all three (3) Winners (and their guests) attending the same Grand Prize Game. Winners will be informed which Grand Prize Game they will attend at or after time of winner notification. Winner must be able to travel so as to attend the applicable game (November 24- 26, 2021); and, if Winner is not available on such dates, prize will be forfeited without compensation and an alternate Winner selected from among all remaining eligible entries received in the corresponding category, as per the judging criteria above (time permitting). The prize includes: roundtrip coach air transportation for two (2) from a major commercial airport near Winner’s legal residence (as selected by the Sponsor) (“Airport of Origin”) to either Detroit, Arlington or New Orleans (collectively “Destination City”) area airport (as chosen by the Sponsor) with possible layovers); provided, however, if the Winner resides within 150 miles of Destination City (as determined by the Sponsor/Administrator in their sole discretion), air travel will not be provided and ground transportation may be provided instead (and, in such case, no alternate prize or compensation will be provided), ground transportation to/from Destination City-area airport and hotel, two (2) nights’ hotel accommodations for Nov 24 and Nov 25, 2021 (standard room, double occupancy), and two (2) tickets to the Grand Prize Game (ticket type and seat location are of the Sponsor’s sole choosing; terms and conditions of ticket as well as venue restrictions apply) (collectively, the “Grand Prize”). Approximate Retail Value of each Grand Prize: $4,000. Total ARV of all prizes to be awarded in the Contest: $12,000. See additional travel restrictions/conditions below.
In conjunction with the Grand Prize Game (e.g., prior to the start of the Grand Prize Game), Winners and perhaps their guests may be recognized via televised (and on radio) public announcement and/or on-field ceremony during the Grand Prize Game. The Sponsor will determine in its sole discretion whether (or not) to proceed with such public announcement and/or on-field ceremony. If the Sponsor elects to proceed, all parameters and elements of the public announcement and/or on-field ceremony shall be determined by the Sponsor in its sole discretion in coordination with the NFL Entities; and, in such event, Winners and perhaps their guests agree to follow all instructions of Sponsor and/or NFL Entities as to their participation in same which may include changing their clothing. As between the Sponsor and the NFL Entities on the one hand, and Winner and perhaps their guests on the other, the Sponsor and the NFL Entities shall own any and all rights to any recordation of the public announcement and/or on-field ceremony. Winner will receive a commemorative trophy or plaque. Conversely, if the Sponsor decides not to proceed with the public announcement and/or on-field ceremony, the Sponsor and the NFL Entities (as well as the Administrator) shall NOT have any liability to Winners and their guests other than the Grand Prize as described above. For clarity, the recognition of Winners and perhaps their guests in conjunction with the Grand Prize Game has no retail value.
Winner and guest must travel together on specified itinerary as set by the Sponsor/Administrator, including same departure date, destination and return date or Grand Prize may be forfeited in its entirety. The Sponsor/Administrator are not liable for delays, cancellation or unforeseen events related to the flights. Grand Prize Winner and guest will be solely responsible for obtaining valid identification. In addition, Winner and guest may be required to present a valid credit card at the hotel at the time of check-in. Winner and guest must provide their own transportation to and from departure airports.
Guest of Winner need not be the Submitter who nominated Winner. Guest must complete, sign and return a Liability Release, Publicity Release (where lawful) and background check form prior to prize travel. If guest is a minor in his/her jurisdiction of residence, such minor’s parent/legal guardian must be the Grand Prize Winner and sign a Release on his/her behalf. Should Winner elect to travel without a guest (or if guest fails to timely return signed Release), prize will be awarded in increments appropriate for a single traveler (that is, the winner him/herself) and no alternate prize or compensation will be awarded.
Actual final value of each Grand Prize may vary depending upon point of departure and fare fluctuations; and, under no circumstances will a Winner receive the difference between ARV and actual final value of Grand Prize in cash (or in any other form). Grand Prize is non-transferable and cannot be extended beyond the date set forth above. Each Grand Prize Winner is solely responsible for all other expenses related to trip not specified herein, including but not limited to: roundtrip transportation between winner’s residence and departure airport, airline baggage fees, tips, taxes, travel insurance and hotel incidentals. Air transportation tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. The Sponsor and its agencies are not liable for any expenses incurred as a consequence of NFL game or flight cancellation/delay.
Winners and their guest(s) must follow all instructions of the Sponsor. (This includes but is not limited to if the Sponsor decides to proceed with (televised or not) public announcement and/or on-field ceremony in conjunction with Grand Prize Game, as discussed above.) Failure to do so may result in forfeiture of the prize. Should a winner and/or guest fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by the Sponsor in their sole discretion), the Sponsor reserves the right, without further notice or warning, to terminate the trip or other applicable experience early, in whole or in part, and send Grand Prize Winner and/or Winner’s travel guest home and/or take other actions as the Sponsor deems appropriate in their sole discretion without any liability or other obligation to Winner or guest. Inappropriate behavior includes but is not limited to the failure of Winner or guest to comply with governmental mandates, prize supplier or other third party requirements designed to prevent the spread of COVID-19 (such as, mask-wearing, social distancing, completion of health questionnaire). Participation in applicable activity/activities may also be conditioned upon provision of proof of a negative COVID-19 test or satisfactory proof of being fully vaccinated against COVID-19.
NOTWITHSTANDING THE FOREGOING, IT IS ALSO POSSIBLE THAT THE COVID-19/CORONAVIRUS PANDEMIC DIRECTLY OR INDIRECTLY MAY COMPEL THE SPONSOR TO DELAY/POSTPONE INDEFINITELY (OR FOR A SIGNIFICANT PERIOD) OR EVEN CANCEL ALTOGETHER A TRIP; THE PRECEDING INCLUDES BUT IS NOT LIMITED TO THE NFL POSTPONING THE GAME SCHEDULED FOR NOVEMBER 25, 2021. IN SUCH CASE (WITH A SIGNIFICANT DELAY BEING DETERMINED BY THE SPONSOR IN ITS SOLE DISCRETION), THE SPONSOR’S LIABILITY SHALL BE LIMITED TO AWARD A PRIZE OF ITS SOLE CHOOSING WHICH IS OF COMPARABLE VALUE IN LIEU OF THE TRIP TO THE GAME.
Award of prize is subject to any prohibition/restriction of Winner’s employer as to acceptance of prizes/gifts from third party entities. The preceding includes but is not limited to the U.S. Military and county and local police.
Prizes are not redeemable for cash or transferable. No substitutions allowed, except as set forth in these Rules and at the Sponsor’s sole discretion, a prize (or prize component) of comparable or equal value will be provided. Prizes are awarded “as is” with no warranty or guarantee by the Sponsor. Federal, state and local taxes as well as all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Limit of one (1) Grand Prize per person.
All applicable federal, state and/or local taxes are the sole responsibility of the Winners, who will receive an IRS Form 1099 reflecting the actual final retail value of the Grand Prize. Winners must submit a validly executed IRS form W-9. Winners further agree to otherwise fully cooperate with the Sponsor/Administrator as to their compliance with governmental tax-reporting requirements.
Submitter and Nominee each irrevocably waive all claims against the National Football League, its member professional football clubs, NFL Ventures, Inc, NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC, NFL Productions LLC, NFL International LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) and agree that or
The NFL Entities will have any liability or responsibility for any claim arising in connection with participation in this Contest other than the award the prizes to Winner recipients as outlined in these rules. The NFL Entities have not offered or sponsored this Contest in any way.
Conditions and Limitations of Liability: Submitter and Nominee each irrevocably waive all claims against Sponsor and U.S. Semiquincentennial Commission. By participating, each Submitter and Nominee agrees: (a) to be bound by these Official Rules and the decisions of the Sponsor and the Administrator, which shall be final and binding in all respects; and (b) to release, discharge and hold harmless each of the Contest Entities, NFL Entities, Facebook, Inc., Twitter, Inc., LinkedIn, TikTok, Inc., each of their respective advertising and promotion agencies, any entity responsible for the administration of this Contest, each of the foregoing entities’ respective parent, subsidiary, related, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage, including, without limitation, death and bodily injury, arising in any manner, directly or indirectly, in whole or in part, from participation in this Contest or any Contest-related activity (including without limitation, any travel related thereto), and/or from Nominee’s acceptance, receipt, use or misuse of the Prize (including without limitation, any failure to pay taxes thereon).
By accepting a prize, Winner grants the Licensed Parties and the NFL Entities permission to use his/her name, voice, likeness, photograph, Prize information, biographical data and city and state of residence on a winner’s list (if applicable) and for programming, publicity and promotional purposes, worldwide in all forms of media now known or hereafter developed, in perpetuity, without further compensation unless prohibited by law. (The preceding includes but is not limited to the possible recognition of winners and perhaps their guests via televised or broadcast public announcement and/or on-field ceremony in conjunction with the Grand Prize Game.) The Licensed Parties and the NFL Entities are not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at the Sponsor’s discretion, without further obligation or compensation. Contest subject to the laws of the United States only. All federal, state and local laws and regulations apply. All Essays become the property of the Sponsor and may not be acknowledged.
Disputes: Arbitration/Choice Of Law: Except where prohibited, Submitters/Nominees agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the awarding of prizes/determination of prize winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of JAMS, then effective (notwithstanding the foregoing, Submitter/Nominee shall not be precluded from seeking relief in small claims court for disputes/claims within the scope of the jurisdiction of small claims court and any remedies available to Submitter/Nominee under applicable federal, state or local law remain available to Submitter/Nominee and are not waived pursuant to this section); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will Submitter/Nominee be permitted to obtain awards for and Submitter/Nominee hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased and any and all rights to injunctive relief. The arbitrator hearing such dispute/claim/cause of action shall be neutral and the Submitter/Nominee will have a reasonable opportunity to participate in the selection of the arbitrator. Such arbitration will take place in Washington, D.C. and the Submitter/Nominee has the right to an in-person hearing in the arbitration proceeding, if desired. The arbitration will allow for the discovery and/or exchange of non-privileged information between Submitter/Nominee and the Sponsor. Should a Submitter/Nominee initiate arbitration pursuant to this section, the Submitter shall be responsible for JAMS’s fees to do so (approximately, $250), with all other costs of such arbitration being borne solely by the Sponsor. If Submitter/Nominee is a California resident and the Sponsor is the prevailing party in such arbitration, such Submitter/Nominee will not be responsible for the Sponsor’s costs and fees in conjunction with the arbitration proceeding; BUT, IN ALL OTHER CASES, Submitter/Nominee WILL BE RESPONSIBLE FOR SUCH COSTS/FEES IF REQUIRED BY THE ARBITRATOR’S RULING. For the avoidance of doubt, the requirement to arbitrate disputes pursuant to this section is reciprocal and binding both upon Submitters/Nominees and the Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Submitter/Nominee and/or Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Washington D.C., without regard for conflicts of law doctrine of Washington D.C or any other jurisdiction and all proceedings shall take place in Washington D.C
